We produce components for firearms. Firearms can be lethal if not properly used and/or maintained. The assembly or installation of firearm parts and components should only be performed by those who are familiar with the components of a firearm and the proper installation of our products. Improper use, misuse, untrained use, improper installation and untrained installation may result in damage to property, personal injury or death. Only install component parts on the specific make and model of the firearm for which they are designed and specified. If you are not properly trained in the installation of these parts, have them installed by a gunsmith or armorer.
By purchasing our product, it is your responsibility to ensure that you take all necessary precautions and follow responsible safety behaviors when assembling, installing, using and maintaining a firearm and all firearm components.
RESPONSIBLE SAFETY BEHAVIOR: Firearms are dangerous and can cause serious injury or death if they are misused or used inappropriately. Safety must be the prime consideration for anyone who owns or handles firearms. Safe use of our product in a firearm is your personal responsibility and the failure to follow responsible safety behavior may result in severe personal injury or death to you or others. We will not be responsible for any personal injury, death or property damage that results from the criminal or negligent use of our product; a disregard of the instructions and warnings provided, improper or careless handling of our product (including any firearm with our product installed), the use of non-standard, defective or improper ammunition or improper or negligent modifications or repairs to our product and any firearm with our product installed.
Responsible safety behavior includes, without limitation: (i) always keep a firearm pointed in safe direction, regardless of whether it is loaded or not; (ii) always treat every firearm as if it is loaded and will fire; (iii) never place your finger on the trigger guard or on the trigger unless you intend to fire; (iv) always be sure of your target and what is behind it; (v) when installing any component, ensure the firearm is not loaded and strictly adhere to the provided installation instructions; (vi) never rely upon any mechanical features of a firearm, only safe firearm handling habits; (vii) before handling any firearm, understand and familiarize yourself with the mechanical features; and (viii) ensure the product you purchased from us is compatible with the firearm that our product will be installed in. It is your responsibility and duty to understand firearm safety and to properly secure and handle firearms. Firearm safety information may be found on such sites as www.projectchildsafe.org.
COMPLIANCE WITH APPLICABLE LAWS: It is your responsibility to ensure that you abide by all applicable National Firearms Act (NFA) rules and regulations, as well as any applicable local, state and federal laws and requirements. Installation of different component parts on your firearm can affect its legality. Always ensure that your firearm will remain legal to possess and use pursuant to federal, state and local laws before replacing any of its component parts. If you have any questions about the legality of installing our product on your firearm, contact an attorney, your State Attorney General’s Office, or your State Police. We make no representations regarding the legality of installing our product on your firearm.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISK: WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ASSUME ALL RISK AND LIABILITY FOR THE RESULTS OBTAINED BY THE USE OF OUR PRODUCT IN THE PRACTICE OF ANY PROCESS, GENERAL EFFECTIVENESS, SUCCESS OR FAILURE, REGARDLESS OF ANY ORAL OR WRITTEN STATEMENTS MADE BY US, BY WAY OF TECHNICAL ADVICE OR OTHERWISE, RELATED TO THE USE OF OUR PRODUCT.
IMPROPER UNDERSTANDING OF HOW OUR PRODUCT OPERATES MAY LEAD TO UNINTENTIONAL OR NEGLIGENT DISCHARGE OF A FIREARM SO EQUIPPED AND MAY LEAD TO PROPERTY DAMAGE, SERIOUS PHYSICAL INJURY OR EVEN DEATH. YOU ARE AWARE AND UNDERSTAND THAT FIREARMS ARE INHERENTLY DANGEROUS AND INVOLVES THE RISK OF PROPERTY DAMAGE, SERIOUS PHYSICAL INJURY OR EVEN DEATH. NOTWITHSTANDING THE RISK, BY PURCHASING OUR PRODUCT YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PURCHASING OUR PRODUCT WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM YOUR USE OF OUR PRODUCT.
WAIVER OF RIGHTS: By purchasing and/or using our products, you hereby expressly waive and release any and all claims, now known or hereafter known, against us, and our officers, directors, managers, employees, agents, affiliates, members, successors, and assigns (collectively, "Releasees"), on account of injury, disability, death, or property damage arising out of or attributable to the use of our products. You hereby covenant not to make or bring any such claim against us, or any other Releasee, and forever release and discharge us and all other Releasees from liability under any such claims.
INDEMNIFICATION: By purchasing and/or using our products, you hereby agree to defend, indemnify, and hold harmless us and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by/awarded against us or any other Releasees in a final non-appealable judgment, arising out or resulting from any claim of a third-party related to the purchase and/or use of our product, including, without limitation, any claim related to your own negligence or the ordinary negligence of any third-parties.
TRANSFER OR PRODUCT: If you should sell, lease, gift, or let someone borrow or use, or in any way transfer a firearm with our product installed to any other individual (recipient/assign), you agree, as a condition of acquiring this product, to accept the responsibility of ensuring the recipient is fully aware and agrees to the conditions set forth herein. Failure to assign this product to a recipient or third party without first providing acknowledgment and acceptance by the recipient of the conditions set herein will be grounds for liability on your part as the original purchaser.
BINDING EFFECT: By the purchase and/or use of our product, you agree this waiver shall be binding upon you as well as your next of kin, personal representatives, heirs, beneficiaries, and assigns and shall inure to the benefit of us and our successors and assigns.
SEVERABILITY: If any of the provisions herein are for any reason declared to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable.
GOVERNING LAW: The provisions contained herein shall be governed in all respects by the laws of the State of Arizona without regard to conflict of law principles. Any action or claim shall be brought in Maricopa County, Arizona.
DISPUTE RESOLUTION: To the extent permitted by applicable law, any controversy or claim arising out of or relating to our products, their design, functionality, or materials and the provisions contained herein, or a breach thereof, will be settled by binding arbitration in accordance with the Arbitration Rules of the American Arbitration Association. Under this arbitration provision, you give up the right to resolve any controversy or claim arising out of or relating to the product, including its design, functionality, materials, or these provisions by a judge and/or a jury. You also agree not to participate as a class representative or class member in any class action litigation, any class arbitration or any consolidation of individual arbitrations. You and us specifically agree to the binding nature of the arbitration.
ELECTION: Please contact us if you have any questions. However, if for any reason the conditions set forth herein are unacceptable to you, THEN DO NOT PURCHASE OUR PRODUCT. If you have already purchased our product, and you do not agree to the terms set forth herein, then we encourage you to contact us.
THIS IS A WAIVER AND RELEASE OF LIABILITY. YOU AGREE TO THIS ENTIRE DISCLAIMER. YOU AGREE TO ALL OF THE PROVISIONS HEREIN AND UNDERSTAND THAT YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO ALL OF THE PROVISIONS. BY PURCHASING, AND CONTINUING TO RETAIN OUR PRODUCTS, YOU ARE INDICATING YOUR VOLUNTARY AGREEMENT TO THESE PROVISIONS.
